What Is the North Carolina Complex Family Financial Court?

The Complex Family Financial Court is designed for qualifying North Carolina family law cases involving unusually complicated financial issues.

The legislation contemplates cases involving equitable distribution, alimony, postseparation support, child support, or combinations of those claims. Financial complexity may arise from closely held businesses, trusts, real estate, executive compensation, retirement plans, post-separation earnings, tax consequences, or other difficult financial questions.

The important distinction is complexity—not simply wealth.

A high net worth marital estate consisting primarily of cash and publicly traded securities may be relatively straightforward. A smaller estate containing a closely held business, disputed separate property, complicated executive compensation, or significant tax issues may present far more difficult valuation and equitable distribution questions.
